Mass Torts Cases
Did you know mass tort cases are filed by millions of people each year? They can result from prescription drug issues, medical devices, defective products, and more. Additionally, these can leave plaintiffs with serious injuries and even death. When considering how best to increase your caseload, what are some of the best mass tort leads to have in your caseload?
In 2017, an active ingredient in Roundup was added to the known carcinogen list. So far, three juries have found that Monsanto should have warned of the alleged risks. And these mass tort cases are profitable. As of March 2022, Bayer/Monsanto paid roughly $11 billion to settle nearly 100k outstanding claims. This covers about 80% of total Roundup claims filed, with approximately 30,000 cases still pending.
2) 3M earplugs
Defense contractor 3M was the exclusive earplug provider to the U.S. military from 2006 to 2015. But the earplugs were defective. In January 2022, a federal jury ordered 3M to pay two U.S. Army veterans $110 million in hearing loss damages. Juries have awarded $160 million in hearing loss damages. And more than 280k cases are still pending against the manufacturer.
Paraquat is the main ingredient in many commercially sold herbicides used on American farmland. When there were 50 accidental paraquat poisoning deaths in 2013, it led to new licensing and sales restrictions. Recent studies link paraquat exposure to a 2.5x increased risk for Parkinson’s disease.

4) Birth Injury

5) Brain Injury
1.5 million Americans experience a traumatic brain injury each year, many resulting in long-term disability. That’s a huge figure. And there’s more. Cumulatively 5.3 million people are living with permanent TBI-related disabilities in the U.S. today. Living with a brain injury can be difficult. Plus, the lifetime economic cost of a patient’s treatment was estimated to be roughly $76.5 billion in 2021.
Did you know a $30 billion trust fund has been set up for mesothelioma victims and asbestos exposure? Symptoms of mesothelioma can take up to 20-50 years after asbestos exposure! And the life expectancy once diagnosed is only 12 to 22 months. However, the average mesothelioma settlement is between $5 million and $11.4 million.
7) Hernia Mesh
Physiomesh is a sterile, surgically implanted device used to repair ventral hernias. In May 2016, the FDA issued an urgent safety notice to surgeons. Data from two large unpublished studies conducted showed a high rate of hernia recurrence and revision surgery in patients. Physiomesh has since been recalled, active litigation is underway, and more than 20,000 cases are pending.
8) Firefighter Foam
Aqueous Film Forming Foam (AFFF), a type of firefighter foam, is known to contain dangerous chemicals linked to cancer. Firefighting foam lawsuits are being filed around the country, and hundreds of AFFF lawsuits have already been filed. Now is the time to get in on this mass tort!
In 2021, artificial joint maker Exactech issued a voluntary recall of 147,732 implants. Ortho surgeons used these inserts and devices during procedures. The packaging let too much oxygen in, which made some materials oxidize and break down. Exactech reported unusually high failure rates to the FDA for the now-recalled implants and inserts.
10) Talcum Powder
Women that use talcum powder have a 20-30% greater risk of developing ovarian cancer. In 2013, the first talcum powder lawsuit was won in federal court against Johnson &Johnson. In 2022, J&J spun off a newly formed business entity, LTL Management, to resolve 38,000 pending talcum powder claims. This new entity would then file bankruptcy, limiting the remaining plaintiffs’ ability to file appeals or seek additional litigation.
Truvada is a prescription drug used as pre-exposure prophylaxis, or PrEP, to prevent and treat HIV. The lawsuit alleges Gilead knew TDF-based medicines could cause severe kidney and bone damage. Bristol-Myers Squibb agrees to pay $10 million to resolve its liability in a class-action lawsuit over HIV drugs with allegedly inflated prices.
The FDA required all manufacturers to stop selling Zantac made with ranitidine in the U.S. in April 2020. The longer Zantac sits on a shelf, the greater the amount of NOMA and the higher the risk of cancer. Which cancers? Bladder, gastric/stomach, kidney, small intestine, colorectal, esophageal, liver, and pancreatic cancers.
Philips CPAP machine and ventilator recall involved millions of potential victims due to carcinogen and toxic chemical exposure. As this foam in the mask breaks down, it emits toxic chemicals that can cause headaches, vomiting, and lung irritation.
